The Safe Drinking Water and Toxic Enforcement Act, Proposition 65 (Prop 65), provides important consumer information and requires the publishing of chemicals which are believed to cause cancer or birth defects. Specifically, Prop 65 mandates that companies inform citizens of California when a significant amount of a listed chemical is present, resulting in the risk of “exposure.” However, much confusion about the regulation has made it imperative for food, beverage, and consumer product manufacturers to understand Prop 65’s many implications and its potential impact on manufacturing processes.
