“… exempt…unless that product is intentionally marketed or intended for the use of children under 3 years of age”

California

Foods are exempt (but not food packaging)

 

“Consumer product does not include …(4) A food as defined in subdivision (a) of Section 109935”

 

109935. "Food" means either of the following:

(a) Any article used or intended for use for food, drink,

confection, condiment, or chewing gum by man or other animal.

(b) Any article used or intended for use as a component of any article designated in subdivision (a).

Minnesota

“… except a container containing baby food or infant formula”

Washington

“A product designed or intended by the manufacturer … to facilitate … the feeding of a child”
